Terms & Conditions ORA Customs Guide
General
ORA Customs Guide is a subscription for 1-on-1 online coaching sessions of 60 minutes monthly, and is under ORA Offshore Customs Consultancy and is a branch of Hadassah Vorm. ORA Offshore Customs Consultancy is registered at the Chamber of Commerce under registration 65187091, located at the Jacques Dutilhweg 471c, 3065 GL Rotterdam.
Article 1 – The agreement
- The agreement is established by issuing / sending the registration form to ORA Offshore Customs Consultancy.
- Participation in the 1-on-1 online coaching sessions is for duration of 60 minutes per month, which can also be consumed in one session, but also in several sessions less than 60 minutes to a total of 60 minutes per month.
- No legal rights can be derived from the advices and sessions, other than advice based on information provided by the participant in the ORA Customs Guide, and will at all times be under the responsibility of the subscriber or declarant of customs documentation, and for the own risk of the subscriber.
- Participating in one of the 1-on-1 live coaching sessions means agreeing to these Terms and Conditions.
Article 2 – Membership
2.1 ORA Offshore Customs Consultancy reserves the right if the subscription has not been paid
timely validation of the subscription will take place after payment. Therefore, the subscription
must be paid in advance before validation.
2.2 Membership at ORA Offshore Customs Consultancy is on personal basis, but at registration it is
possible when the subscription is for a company to be transferred to someone else in the company.
This is only after approval has been granted for this by ORA Offshore Customs Consultancy.
2.3 Refund of the subscription fee is not possible.
2.4. Cancellation membership subscription: membership can be terminated in writing or by e-mail
with due observance of a notice period of 1 calendar month before the subscription year ends
(example: if the subscriber wants to stop the annual subscription, he/she can indicate this one
month before the start of the new year: if subscription starts at August 1, 2018, must the
subscriber specify this before July 1st, 2019).
2.5 ORA Offshore Customs Consultancy reserves the right to change the rates for subscription(s)
modify. If a subscriber does not wish to accept any change, he/she can take the membership
terminate with effect from the date on which the new annual subscription is renewed. Even then
this must be canceled with due observance of one calendar month before the subscription year
ends.
2.6 ORA Offshore Customs Consultancy holds the right to, with reason and through any
evidence that the subscriber is guilty of misusing information or data for punishable purposes,
subscriber’s 1-on-1 coaching sessions of ORA Customs Guide directly ends, to exclude the
subscriber from further sessions and to terminate the subscription immediately.
Article 3 – Missed coaching sessions
3.1 No refund will take place if the subscription has not been used for a month due to holidays, illness
or other reasons.
Article 4 – Cancellation of coaching sessions
4.1 The subscription price is based on an annual number of 60 minutes 1-on-1 online coaching
sessions per month and for 12 months concatenated.
ORA Offshore Customs Consultancy reserves the right to leave a session in case of force majeure
failure if this was due to an urgent reason or due to force majeure but the subscriber then will be
able to catch up this session at a later time and date.
4.2 If a subscriber has registered for a live 1-op-1 coaching session but by force majeure can not
participate in this session, such as due to illness or other unforeseen circumstances, this coaching
session will be, in consultation with ORA Offshore Customs Consultancy caught up at another
time.
Article 5 – Amendments
5.1 The rates are based on 12 months, 60 minutes per month live 1-on-1 coaching sessions that can be
60 minutes in one session, but may be divided in shorter sessions up to the maximum of 60
minutes per month.
5.2 ORA Offshore Customs Consultancy reserves the freedom to attend the coaching session times
and to change at any time. You will be informed by e-mail.
5.3 ORA Offshore Customs Consultancy reserves the right to modify the ‘Terms & Conditions’. The
subscriber has the right to immediately terminate the agreement with effect from the new
‘General Terms & Conditions’ with due observance of the notice period.
Article 6 – Personal data
6.1 ORA Offshore Customs Consultancy collects personal data; these will be treated as strictly
confidential treated and not be provided to any third party.
6.2 After registration the completed e-mail address on the registration form will be added on ORA
Offshore Customs Consultancy’s e-mail file and the subscriber receives information about
ORA Offshore Customs Consultancy by e-mail. Deregistration is possible via info@oracustoms.nl
Subscriber then agrees that he/she does not have any access to information regarding amendments
and will not receive automatically information about activities anymore.
Article 7 – Aplicability and disputes
7.1 These ‘General Conditions’ apply to all agreements with ORA Offshore Customs Consultancy and
the subscriber regarding 1-on-1 live coaching sessions and other form of training, coaching or
advising in the broadest sense of the word.
7.2 Deviations from this agreement are only binding if confirmed in writing by ORA Offshore
Customs Consultancy.
7.3 All agreements between ORA and the subscriber are governed by Dutch law.
Any disputes between parties will only be submitted to the competent judge in the District
‘Arrondissement’ of Rotterdam.
